Preparing and reviewing residential lease agreements requires careful attention to Ontario’s Residential Tenancies Act, 2006 (RTA). Improper drafting or reliance on unenforceable terms can expose both landlords and tenants to disputes, fines, and unnecessary legal risk.

In Ontario, the Residential Tenancy Agreement (Standard Form of Lease) is mandatory for most private residential tenancies entered into on or after April 30, 2018. The standard lease establishes the core rights and obligations of landlords and tenants under the RTA. These statutory rights cannot be waived, restricted, or overridden, even by mutual agreement.
While the standard lease must be used, it may be accompanied by additional lawful terms, provided they do not conflict with the RTA or the mandatory provisions of the standard form. Any clause that contradicts the RTA is void and unenforceable.
Permissible additional terms may include, for example:
- Smoking policies;
- Rules addressing pest prevention and cleanliness obligations (within legal limits);
- Guest conduct and reasonable noise rules;
- Parking rules and conditions;
- Maintenance and use obligations consistent with the RTA;
- Utility responsibilities and contact arrangements.
These additional terms must be carefully drafted to ensure they are clear, lawful, and enforceable.
